You consider yourself a reasonable person. You have worked hard all your life and now you have bought your dream home. You are entitled to enjoy it.

But your neighbour is busy erecting a fence/wall on your property, effectively claiming a strip of 6 inches of your land, right down to the bottom of the garden.

WHAT DO YOU DO? You have tried talking to him but he has ignored you and has carried on building.

We have seen it all before. "The tree (that marked the boundary for the last 20 years) has moved", he said. "That bush you planted was in the wrong place, you planted it on my side".

Sometimes one has to make a stand. You just cannot walk out on to your garden without that fence/wall, or that driveway, or that ridiculous extension, confronting you, day after day.

What We Will Do For You
  1. First, come talk to us. We will advise whether you have a case. Then we will write a polite and professional letter to your neighbour, putting your side of the story across. That usually gets his attention. He may respond or he may get his solicitors to do so. But he will not ignore you. However if he does not stop erecting that fence/wall, we will make him stop, by serving an injunction on him - that means we will go to Court and get the Judge to issue a Court Order to force him to stop.
  2. We then start negotiations with his solicitors about getting a joint expert who is independent, to state where the true boundary line is. We will agree costs (which is usually shared between the two parties), meet the surveyor on site and ensure that the surveyor does the job properly (sometimes the other side may try to put undue pressure on the surveyor).
  3. An agreement will have been signed by both parties to agree to the surveyor's decision. Hopefully this resolves the situation and both parties adhere to the agreed boundary.
  4. Sometimes, one of the parties are not happy with the surveyor's report. We then go to the County Court for a Judge to decide. This, of course, is more expensive but often necessary if the parties cannot settle out of Court.
What Will It Cost

One often reads in the newspapers about cases costing £50,000 to even a £1 million. Many cases settle before £15,000 is spent after one or two Court hearings. Often if the case does not go to Court, the costs are below £3500.

We will give you an estimate of the costs from Day One. We will keep you updated if costs are being exceeded. There are many factors that can increase the costs of a case, such as your neighbour refusing to hire a solicitor and is therefore ignorant of the law. If the dispute is very bitter and both sides are doing everything they can to make each other's lives a living hell, this can increase costs.

We cannot promise to make your neighbour see sense, but we can offer support and good advice. We have to Protect YOUR interests.

Adverse Possession

The Law of Adverse Possession is often talked about, but not usually understood. The newspapers do a very bad job of informing the public about it. It is not simply a case of claiming someone else's land by filling a form, just because one has been making use of the land for the last 12 years. It is not just about gardening on someone else's land for 20 years or so. Quite often, the owner wants it back and is willing to go to Court.
